FILE - Bond of indemnity - ref. Chap/I/ii/10 - date: 13 November 1805
PARTIES: 1 Richard Fisher of Whatcote, Warwicks., yeoman 2 William Phillips of Kingham, yeoman payment of legacy of £20 SUBJECT OF TRANSACTION: 1 bound to 2 in penal sum of £40 to indemnify 2 against claim for legacy of £20 to Mary Townsend Field out of Lady Meadow in Kingham. Recites will of Anthony Hale, dated 1766 (see cat. ref. Chap/I/ii/10), devising £20 to his niece Mary Townsend Hucking, chargeable upon Lady Meadow: which he had devised to Rachael, wife of James Fisher late of Whatcote. Recites that Mary Townsend Hucking married Joseph Hiatt in Nov. 1777 both signed receipt for same (see cat. ref. Chap/I/ii/3) Recites that Mary Townsend Hiatt later remarried with Samuel Field of Kineton, Warwicks. who is still living. Recites will of Rachel Fisher dated 18 Feb. 1804 (see cat. ref. Chap/I/ii/4) devising residue of her estate to 1. Recites that 1 contracted with 2 for the sale of the fee simple and inheritance of Lady Meadow by indentures of lease and release of 20/21 June 1805, conveying to Joseph Knight to certain uses in trust (see cat. ref. Chap/I/ii/6-7) Recites that said release was intended to contain an acquitance from the said Mary Townsend Field and Samuel Field from any claim on the premises for the said legacy. Recites that said receipt from Hiatt was lost but has now been found, Recites that Samuel Field refuses to execute the said rele [...] or to suffer his wife to do so. Therefore 1 now indemnifies [...] 2 from payment of the said legacy. Also binds 1 to keep covenants mentioned in the said release. CONSIDERATION: £40 PLACES: KINGHAM
